1. Agreement to these terms

These Terms and Conditions ("Terms") form a legally binding agreement between you and AGENCY 54, LLC, a Florida limited liability company trading as Railway Travel, with its principal place of business at 927 Tan Tara TRL, Jacksonville, FL 32221.

By accessing this website or contacting us by telephone, email or text message, you agree to be bound by these Terms, our Privacy Policy, our Disclaimer and our Affiliate Disclosure, each incorporated here by reference.

If you do not agree to these Terms, please do not use this website or our information line.

2. What this service is

Railway Travel is an independent rail travel information service. We publish route guides, station guides, operator profiles and general travel information covering passenger rail in the United States, Canada and the United Kingdom, and we operate a telephone line on which general rail travel questions may be asked.

That is the entirety of the service. Everything on this website is published for general informational purposes.

3. What this service is not

Railway Travel is not Amtrak, VIA Rail Canada, Eurostar, National Rail, Network Rail, Brightline, or any train operating company, transport authority or government agency. We are not affiliated with, endorsed by, sponsored by, licensed by or acting as an agent of any of them.

We are also not a travel agency, a tour operator, a ticketing company or a carrier customer-service centre.

We specifically do not:

• Sell train tickets, airline tickets or any other travel product
• Issue reservations, bookings, tickets or boarding documents
• Accept, process or hold travel payments of any kind
• Operate, control or influence any train service
• Hold or access carrier booking records or reservation systems
• Amend, cancel, refund or otherwise administer any reservation
• Provide customer service on behalf of any carrier

All carrier names, route names, train names, trademarks, service marks and logos appearing on this website are the property of their respective owners and are used solely for identification and descriptive purposes.

4. Telephone calls and call connections

Our information line is provided free of charge. We do not charge you for speaking to us, and there is no obligation of any kind arising from a call.

If you ask to proceed with a reservation, your call may be connected or transferred to an independent third-party travel provider. When that happens:

• That company is a separate business and is not Railway Travel
• We are not a participant in the onward conversation
• Any reservation you make is made directly with that company, under their terms, their pricing and their fee structure
• Any payment you make is made to that company, not to us
• We may receive a referral commission in connection with the transferred call, at no additional cost to you

Before providing payment details to any company you are connected to, ask them to identify themselves and to confirm in full any fees or charges they intend to apply. We have no visibility of, or control over, what a third-party provider charges.

5. Accuracy of information

Route descriptions, journey times, distances, station lists, equipment types, onboard amenities, luggage rules and discount categories on this website reflect our understanding at the time of publication.

Carriers change schedules, rolling stock, catering, station facilities, fares and policies frequently and without notice to us. Seasonal variation, engineering works and equipment substitution all affect what you will actually experience.

We make no representation or warranty as to the accuracy, completeness, reliability, suitability or currency of any information published here. Always confirm current details directly with the carrier before you travel. Nothing on this website forms part of any contract.

6. No fare quotations

We do not publish fares and we do not issue quotations. Where our guides discuss cost in general terms — for example explaining that fare buckets rise, or that a rail pass suits some itineraries and not others — that is background information about how rail pricing works, not a statement about the price available to you.

Prices vary continuously by date, class, availability, route and discount eligibility, and are set entirely by carriers and providers.

7. Your obligations

You agree that you will:

• Use this website and our information line only for lawful purposes
• Not rely on this website as your sole source of travel information
• Confirm schedules, fares, requirements and policies directly with the relevant carrier before travelling
• Obtain and carry all documentation required for your journey, including passports and visas for cross-border travel
• Comply with the conditions of carriage of every carrier you travel with
• Not attempt to interfere with the operation of this website, scrape its content, or gain unauthorised access to any system
• Be at least 18 years of age and legally capable of entering into a binding agreement

8. Third-party providers and links

This website may link to, or our information line may connect you with, independent third-party businesses. We do not own, operate, control or supervise any of them.

We make no representation or warranty regarding the services, pricing, conduct, availability, fees, refund practices or policies of any third party. The presence of a link or a call connection is not an endorsement, recommendation, certification, warranty or guarantee.

Any dispute arising from a transaction with a third-party provider is a matter between you and that provider.

9. Disclaimer of warranties

THIS WEBSITE AND OUR INFORMATION LINE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. We are not liable for the acts, errors, omissions, representations, warranties, breaches, negligence, fees, delays or cancellations of any carrier or third-party provider, nor for personal injury, death, property damage or other loss arising from them.

We are not liable for events beyond our reasonable control, including weather, natural disaster, strike, labour dispute, mechanical failure, government action, civil disturbance, terrorism, epidemic or carrier insolvency.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.

11. Indemnification

You agree to indemnify, defend and hold harmless AGENCY 54, LLC and its members, officers, employees and agents from any claim, demand, loss, liability, damage, cost or expense, including reasonable attorneys' fees, arising out of or relating to your breach of these Terms, your violation of any law or the rights of a third party, or any transaction between you and a third-party provider.

12. Intellectual property

All original content on this website — including route guides, station guides, editorial commentary, page copy, design, layout, graphics and code — is owned by or licensed to AGENCY 54, LLC and protected by United States and international copyright law.

You may view and print pages for personal, non-commercial use. You may not reproduce, republish, distribute, sell, licence, systematically scrape or create derivative works from any part of this website without prior written permission.

Notices of alleged copyright infringement should be submitted under our Copyright & DMCA Policy.

13. Communications and recording

By providing your telephone number you consent to receive calls and text messages from us relating to your enquiry. Consent to marketing communications is not a condition of anything and may be withdrawn at any time. See our SMS Terms.

Calls to our information line may be recorded or monitored for training and quality purposes. Where recording occurs you will be notified at the start of the call and may ask that the call not be recorded. Once a call is transferred to a third-party provider, that provider's recording practices and privacy policy apply.

14. Dispute resolution and governing law

These Terms are governed by the laws of the State of Florida, United States of America, without regard to conflict-of-law principles.

Before commencing any formal proceeding, you agree to contact us and attempt in good faith to resolve the dispute informally for at least 30 days.

Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts. Claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Nothing in this section prevents either party from seeking relief in a small-claims court of competent jurisdiction.

15. General provisions

Entire agreement. These Terms and the policies incorporated by reference constitute the entire agreement between you and us.

Severability. If any provision is held unenforceable, it shall be limited or severed to the minimum extent necessary and the remainder shall remain in force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Changes. We may revise these Terms at any time by posting an updated version, effective from the date of posting.
